A previous course, Law 250 Commercial Law or Law 250 Secured Transactions is recommended but not required for those enrolling in Law 248.
This course examines the United States Bankruptcy Code. Areas of emphasis are: financing, operating and administering debtors' estates; treatment of executory contracts and leases; formulation and confirmation of plans of reorganization; and the avoiding powers of the trustee in bankruptcy. The focus of the course will be business bankruptcies, limited attention will be given to the treatment of the consumer debtor. The material covered in this course can serve as a solid introduction to bankruptcy both for those who are considering specializing in the area and for those who do not plan to do further academic work or practice in bankruptcy, but are interested in general business or commercial law.
