Professor Volokh Comments on Ruling on Constitutionality of Income Tax Surcharge in Forbes Article

October 29, 2009 -- Professor Eugene Volokh commented on a California appellate court ruling that an income tax surcharge the state imposes on income of more than $1 million is constitutional. His remarks appear in a Forbes article.

"There was a lot at stake, but there wasn't a lot surprising in the appellate decision," says Eugene Volokh, a professor and constitutional law expert at the University of California Los Angeles School of Law. "The tax surcharge was open-and-shut constitutional for the same reasons that progressive income taxes generally are constitutional. It's perfectly sensible to treat people differently based on wealth." Volokh says he doubts the California Supreme Court will choose to hear the case, which means the appellate court decision will stand.
