Professor Stout Comments on SEC Subpoena of Nixon Peabody in Daily Journal Article

November 11, 2009 -- Professor Lynn Stout commented on a subpoena of law firm Nixon Peabody and a former partner of the firm as part of an investigation into a client of the firm. Her comments appear in a Los Angeles Daily Journal article.
Lynn A. Stout, a UCLA School of Law professor in corporate and securities law, said it was unusual to subpoena a law firm since client records are protected. Stout said the commission might have subpoenaed work that may not be subject to attorney-client privilege. There are also worse possible reasons.
"It might be highly unusual and you would hope it's certainly not the case, but it could be they're concerned about behavior at the firm itself," Stout said.
