Professor Volokh Comments on First Amendment and Pornography Laws in Forbes Column

April 21, 2014 -- ​Professor Eugene Volokh commented on the First Amendment and criminalizing revenge pornography in a Forbes column.

On the point, Eugene Volokh has said that the Court has “refused invitations to treat civil liability differently from criminal liability for First Amendment purposes.” In an e-mail exchange, he pointed to “New York Times Co. v. Sullivan, Garrison v. Louisiana, and the Court’s rejection of Justice Stevens’ proposal in the late 1970s to bar criminal prosecutions for obscenity.”
