Litigation Torts

When can litigating a case itself create tort liability, whether for you or for your client? How can you avoid such liability? This class will deal with that, focusing on torts such as malicious prosecution (which relates to civil cases and not just criminal ones), abuse of process, and spoliation of evidence; on privileges such as the litigation privilege and the fair report privilege, as a defense against libel lawsuits or other lawsuits that arise from litigation conduct; and on anti-SLAPP statutes, which can make plaintiffs liable for attorney fees if their cases are found to lack merit.
