April 21, 2015 – Professor Emeritus Norman Abrams was quoted in a Bloomberg BNA “U.S. Law Week” Legal News report on the RJR Nabisco case and the implications for applying RICO extraterritorially.
“First of all, RICO is a criminal offense and the argument has some appeal that in this age of globalization the long arm of U.S. criminal justice should be able to reach criminal conduct that affects U.S. interests,” he said.
“But secondly, RICO also provides attractive treble damage civil remedies, and undoubtedly the civil use of RICO claims has been subject to some abuse in the domestic U.S. cases,” he said.
