Professor Volokh's Blog Quoted in Times of Israel on Associate Justice Samuel Alito's Dissent to Ben-Levi v. Brown

March 3, 2016 – Professor Eugene Volokh’s blog post was quoted in a Times of Israel article about Associate Justice Samuel Alito dissenting to the U.S. Superior Court decision not to hear a case in which a Jewish inmate challenged a prison’s policy prohibiting him and fellow inmates to pray and study the Torah.

“The court’s refusal to grant review isn’t a judgment on the merits, and it’s also not a precedent…[the Supreme Court] often declines to review cases because it doesn’t think the decisions (right or wrong) merit the justices’ time, or because there are procedural problems with the case,” Professor Volokh explained.
