Professor Volokh Quoted in Florida Times-Union on Veterans’ Group Request to Raise Confederate Flag on City Property

April 21, 2016 – Professor Eugene Volokh was quoted in the Florida Times-Union about a request by the Sons of Confederate Veterans to raise a 75-foot flagpole on Jacksonville, Florida city property near an interstate, a request which was denied by the city planning commission out of concern that the group’s intention was to raise a large Confederate flag. 

If the Planning Commission was willing to approve the flagpole if the Confederate issue wasn’t brought up, then it violated [the group’s] First Amendment rights, said Professor Volokh.

“You cannot say, we’ll give you a variance if you display a flag we like, but we won’t give you a variance if you display a flag we don’t like,” he said.
