Eugene Volokh Tells U.S. News Cannabis Industry Wants Free Speech Rights in Merchandising

Professor Eugene Volokh spoke with U.S. News & World Report about California’s initiative to restrict the cannabis industry from using branded merchandise to promote marijuana products. The state argues that the initiated bill is intended to keep cannabis away from children, but the industry claims that the merchandising ban would place a limit on free speech rights. Volokh says the dispute would be heard in a California state court, as under federal law, marijuana is still classified as a dangerous drug and commercial ads are therefore not constitutionally protected.
