Professor Eugene Volokh was cited by the New York Times in an article about the “Wedding Cake Case” which is to be heard by the Supreme Court and which involved a baker who refused to make a wedding cake for a same-sex couple. Professor Volokh stated that the dispute is over where, not whether, a line should be drawn on what is considered free speech. “At some point, you have to decide what counts as speech and what doesn’t. Otherwise, all human behavior could be said to be expressive,” asserted Volokh.
