Eugene Volokh Cited in Slate on Masterpiece Cakeshop Case

Professor Eugene Volokh was cited in a Slate article on Masterpiece Cakeshop v. Colorado Civil Rights Commission, a Supreme Court case addressing whether or not commercial bakers have a constitutional right to refuse same-sex couples service. The shop has argued that being forced to follow the state’s anti-discrimination laws violates their First Amendment right. However, “antidiscrimination laws, like other laws, should not be stymied by attenuated claims of incidental burden, where no real constitutional problem is present,” argued Volokh.
