Cybersecurity, Business & the Law

Cybersecurity risk is a top issue of concern, according to a recent survey of general counsel.  For the foreseeable future, almost all lawyers will benefit from being able to spot issues and generally advise clients on cybersecurity.  This course will survey the legal issues implicated by cybersecurity with a focus on business clients since over 85% of critical infrastructure is owned and operated by the private sector.  After introducing key technology and cybercrime concepts and trends, the course will analyze a business’ duty to protect against cyber threats under securities laws, consumer protection and privacy laws such as the FTC Act and Europe’s General Data Protection Regulation, and industry-specific regulations addressing financial services, health, and other key sectors.  Practical application of legal concepts in realistic scenarios, such as ransomware response, breach investigations, and business transactions, will feature prominently in the course.
