Labor Law & Collective Action

Business & Tax Law, Constitutional & Public Law, Entertainment Law, Public Interest Law

This course surveys the law of worker collective action centered on federal labor law governing unionization of private-sector employers.  We will study organizing, collective bargaining, enforcement of union contracts, and the role of strikes, pickets, and lockouts. Coverage includes the structure, function and jurisdiction of the National Labor Relations Board. We also will examine more briefly additional forms of worker collective action including worker centers, co-ops, and organizing by workers outside of employment relationships. Comparisons will be drawn to collective action by others such as consumers, debtors, or tenants.
